Marriage is a special contract of permanent union between a man and a woman entered into in accordance with law for the establishment of conjugal and family life. It is the foundation of the family and an inviolable social institution whose nature, consequences, and incidents are governed by law and not subject to stipulation, except that marriage settlements may fix the property relations during the marriage within the limits provided by this Code.
The Philippines is known as a country filled with rich culture and tradition. Its roots date back from the Negritos followed by the different occupations, until flourished into a pot of mixed races. Since then on, different tribes and ethnic groups have formed their own rituals and celebrations in binding two people of the different sex, for the intent to consumate the marriage. Moving on to the present time, marriage is still as strong as ever. Although, a handful of Filipinos have decided to follow the Western tradition of common law marriage (live-in), majority of the population still prefer to get legally married. The main question to be raised is- what do you get from marriage? You see, marriage is a bind that is created by law, and in a lot of situations blessed by the church. As much as we want to think of marriage as a fairy tale, a lot of people use it as a means of survival. There is this common notion of “what’s mine us yours, what’s yours is mine”. Before getting married you may fix your property relations, but not after the marriage takes place; because Article 1 clearly states- it is not subject to stipulation except for marriage settlements done before the marriage. Let us not dwell into that matter, for it would make this reading too long. The main purpose of this piece is to show you how to bend the laws governing marriage. See, there are two ways: the easy and the hard part. The easy part is you get married below 21 without the parental consent. That marriage would not be void ab initio, rather it would be voidable. Voidable marriages remain valid until annulled. So here, you have the upper hand because you have the choice of staying or leaving. Think of it as a trial or a testing stage. However, bear in mind that you have a prescriptive period to file for annulment-
Art. 45. A marriage may be annulled for any of the following causes, existing at the time of the marriage:
Art. 47. The action for annulment of marriage must be filed by the following persons and within the periods indicated herein:
In this scenario you are fighting against time. If ever you are over that age, there are other grounds for annulment- fraud, force, intimidation, undue influence, impotency, STD (read Gimenez vs Canizares). If it doesn’t fall under these situations, file for the declaration of nullity of your marriage on the grounds of psychological incapacity. Unfortunately, proving psychological incapacity is hard and the guidelines are rigid. Nonetheless, it’s easy to find a psychological problem, that’s just my opinion (read Molina guidelines for psychological incapacity).
Now, if it still does not work, use the second option. If you’re a dual citizen it’s easier to do- change your citizenship, then file for a divorce. A Filipino citizen can never file for a divorce case. this is because as stated in Artick 15 of the Civil Code :Laws relating to family rights and duties, or to the status, condition and legal capacity of persons are binding upon citizens of the Philippines, even though living abroad.
Once you have done the divorce, wait for sometime and change your citizenship back to Filipino. You just need to go through a process of naturalization before you can become a full pledged Filipino again.
Just remember, if you can’t break the law, be the law.
